Residency Requirements For Divorce In California

Not everybody who lives in Temecula can file for divorce. Like most states, California has a minimum residency requirement before a married person can file here. Specifically, you or your spouse must have lived in California for at least six months and your current county for at least the last three months.

What Are The Grounds For Divorce In California?

There are two available grounds for divorce or legal separation: irreconcilable differences and permanent incapacity to make decisions.

  • “Irreconcilable differences” means that problems in your marriage have caused the relationship to break down permanently. This is also known as “no-fault divorce.”
  • If your spouse has become mentally incapacitated due to illness or injury, you can seek divorce on the grounds of their permanent incapacity to make decisions if you can provide medical or psychiatric testimony in support.

Like with many legal proceedings, the order in which you and your spouse deal with property division, child custody and child support depends on your particular situation. Usually, the judge will examine the evidence to decide what should be addressed first.
